Terms of Service

Welcome to Mitch. These Terms of Service ("Terms") govern your access to and use of the Mitch website and your purchase of products from our online store (the "Store"). By accessing the Store or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Store.

1. Eligibility

By using the Store, you confirm that you are at least 18 years old, or that you are using the Store under the supervision of a parent or guardian, and that you have the legal capacity to enter into a binding contract.

2. Products and Pricing

All products are subject to availability. We may limit or discontinue any product at any time.
We make every effort to display product colours and images as accurately as possible, but we cannot guarantee that your screen accurately reflects the actual colour of the product.
All prices are displayed in Euros (€) and include applicable VAT unless stated otherwise. Shipping costs, where applicable, are shown at checkout.
We reserve the right to correct any pricing errors and to change prices at any time without prior notice. The price applicable to your order is the price displayed at the time your order is confirmed.

3. Orders and Acceptance

When you place an order, you will receive an order confirmation email acknowledging that we have received your order. This confirmation does not constitute acceptance of your order. A contract between you and Mitch is formed only when we dispatch the products to you. We reserve the right to refuse or cancel any order for any reason, including suspected fraud, errors in pricing or product information, or unavailability of stock. If we cancel an order that has already been paid for, you will receive a full refund.

4. Payment

Payment must be made in full at the time of ordering through the payment methods available at checkout. By providing payment details, you confirm that you are authorised to use the chosen payment method. All transactions are processed securely by our payment providers; we do not store your full card details.

5. Shipping and Delivery

Orders are processed and dispatched within 48 business hours at the latest. Once dispatched, estimated delivery takes between 7 and 13 business days, depending on your location. For full details, please see our Shipping Policy.

6. Returns and Refunds

You may have the right to return your order under the conditions set out in our Returns & Refund Policy, which forms part of these Terms.

7. Intellectual Property

All content on the Store, including but not limited to the Mitch name and logo, text, graphics, images, product designs, and layout, is the property of Mitch or its licensors and is protected by intellectual property laws. You may not copy, reproduce, distribute, or use any content without our prior written permission.

8. Acceptable Use

You agree not to use the Store for any unlawful purpose, to infringe our rights or those of third parties, to introduce malicious code, or to attempt to gain unauthorised access to our systems.

9. Limitation of Liability

To the fullest extent permitted by law, Mitch shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Store or the products. Nothing in these Terms excludes or limits our liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, or for fraud. This does not affect your statutory rights as a consumer.

10. Changes to These Terms

We may update these Terms from time to time. The version published on this page at the time you place an order applies to your purchase. We encourage you to review this page periodically.

11. Governing Law

These Terms are governed by the laws of Belgium. Any disputes will be subject to the competent courts of (judicial district — e.g. Brussels), without prejudice to any mandatory consumer protection rights you may have in your country of residence. EU consumers may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
